Your rights to fair pay

The minimum wage is a worker’s base rate of pay for the ordinary hours works and is generally dependent on the relevant industrial instrument that applies to their area of employment.

The minimum wages received by workers in the national workplace relations system are received every year by the Fair Work Commission and adjustment to the rate of pay take effect on 1 July each year.

Workers should check their relevant modern award(s) to determine whether the rate of pay they are receiving in correct.

The current minimum wage is $16.87 per hour or $640.90 per 38 hour week (before tax).

On top of this, workers are also entitled to superannuation, leave entitlements and any pay loading for extra hours works outside the 38 hour work week.

It is an offence for an employer not to pay the correct base rate and other entitlements as it breaches the Fair Work Act.
